This Policy explains the responsibilities of vendors and users concerning intellectual property and provides a process for reporting suspected copyright, trademark, design, or other intellectual-property infringement involving ShoppingSuru listings or content.
Vendors must have the necessary rights or permissions to use the content, brands, photographs, designs, logos, and other materials they upload to ShoppingSuru.
Intellectual property may include, depending on the circumstances:
Photographs, artwork, written descriptions, videos, graphics, illustrations, and other creative works.
Brand names, logos, marks, trade names, and other trademark-protected identifiers.
Product designs, visual designs, patterns, and other protected design elements where applicable.

Vendors are responsible for ensuring that the products and content they submit to ShoppingSuru can lawfully be offered through the marketplace.
A vendor represents that it has the necessary rights, licences, permissions, or authorization to use:
Vendors should upload photographs and other content that they own or are authorized to use.
Vendors should not copy another retailer's product photographs, promotional graphics, descriptions, or other protected content without appropriate permission.
Where ShoppingSuru requires product images, vendors should provide images that accurately represent their own products.
Vendors must use brand names and trademarks accurately and lawfully.
A vendor must not:
Genuine branded products may be listed where the vendor has a lawful basis for selling and describing them.
ShoppingSuru does not permit counterfeit products or products falsely represented as genuine branded products.
A credible report concerning suspected counterfeit products may result in temporary listing restrictions while the matter is reviewed.
To operate the marketplace, vendors grant ShoppingSuru a non-exclusive, limited, royalty-free licence to host, reproduce, display, format, transmit, and otherwise use approved vendor content for legitimate ShoppingSuru purposes, including:
The licence does not transfer ownership of the vendor's intellectual property to ShoppingSuru.
By uploading or submitting content, the vendor represents that, to the best of its knowledge:
A rights holder or authorized representative may report suspected intellectual-property infringement involving a ShoppingSuru product listing or other content.

Vendors must respond honestly and should provide available documentation demonstrating lawful ownership, authorization, sourcing, or use rights where relevant.
Depending on the circumstances, ShoppingSuru may:
Where a customer has purchased a product that is reasonably determined to be counterfeit or falsely represented as genuine, ShoppingSuru may facilitate an applicable return, replacement, refund, or other remedy under the Refund, Return & Exchange Policy and applicable law.
The vendor may be responsible for applicable costs under the Vendor Agreement.
A vendor with repeated credible intellectual-property complaints may face escalating marketplace action.
Serious or deliberate infringement may justify immediate suspension or termination.
The intellectual-property reporting process must not be used to unfairly target legitimate competitors or suppress genuine lawful products.
ShoppingSuru may take appropriate action where a report is knowingly false, fraudulent, abusive, or submitted primarily to disrupt a legitimate vendor.
ShoppingSuru's own branding and platform materials may include:
These materials may not be copied, reproduced, distributed, modified, or used commercially without appropriate permission, except where permitted by applicable law.
Reviews, photographs, descriptions, questions, messages, and other user-submitted content remain subject to the applicable ShoppingSuru terms and content policies.
By submitting content, the user or vendor must ensure that they have the necessary rights to provide it and authorize ShoppingSuru to use it for the purposes permitted by the relevant policy.
